Coral Springs man chokes ex, dumps backpack filled with feces on her, police say
A tip led to the discovery that a Coral Springs man had physically harmed his ex-girlfriend who was staying with him, culminating in him throwing a backpack at her filled with his own excrement, police said.
Daniel Niemiec, 20, is now charged with domestic battery by strangulation and two counts of domestic battery.
Investigators received a tip on July 1 that Niemiec was abusing his ex-girlfriend at his Coral Springs apartment, according to a probable cause affidavit. She was visiting friends in Florida and staying with Niemiec, her recent ex-boyfriend, family told police.
While officers were trying to get in touch with the victim, they located her mother, who reportedly told them that on June 2, her daughter texted her saying, “I love him but he just hurt me he choked me out and hit me.”
When police met with the victim, she said the day she texted her mom that, she and Niemiec were having sex when he slapped her in the face multiple times and continued to do so after she told him to stop, according to the affidavit. She sent her mom photos of redness on her face, police said.
A few weeks later, she and Niemiec got into an argument in the living room, and he put his hands around her throat, choking her, she told officers. She said she tried to scream for help but couldn’t, and when he released her, she was gasping for breath, the arrest report says.
She left his apartment after that incident and went to stay with a friend, then the next day, July 1, she and her friend went to Niemiec’s apartment to get her things, police said.
She said Niemiec met them outside in the parking lot and dumped the backpack on her, only for her to realize he had “defecated on, urinated on and filled her backpack with hot sauce, ketchup and other unknown fluids,” according to the affidavit.
A witness also said he saw Niemiec dump the contents of the backpack onto the victim, the report says.
Police arrested Niemiec at his apartment, and he reportedly agreed to speak with officers after being read his rights. The affidavit says Niemiec told police he had slapped the victim while he was “testing something new and did not know the limits of the situation.”
In reference to the choking allegation, he said he has anger issues and sometimes loses control, adding he put his hands around her throat while they were arguing, police wrote in the affidavit.
He also told investigators he thought the victim had cheated on him, so he filled her backpack with a concoction of excrement, soda and hot sauce, then threw it at her as “payback,” the report says.
Records indicate Niemiec has bonded out of Broward jail.
